The SUBATRA Programme supports the Bangsamoro Transition Authority (BTA) Parliament in its mission to build robust legislative, administrative, and governance frameworks for the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM). To align with the principles of inclusivity and moral governance, BTA Parliament Bill No. 336, the proposed Bangsamoro Gender and Development (GAD) Code, aims to institutionalize gender mainstreaming, promote gender equality, and safeguard the rights of all individuals within the region. This consultancy is aimed at strengthening the proposed Bangsamoro GAD Code by ensuring its alignment with Islamic principles, international standards, and national frameworks while addressing its practical application, inclusivity, and enforceability.
Job description
Objective
The consultant will provide technical expertise to review, analyze, and enhance the proposed Bangsamoro GAD Code, focusing on:
- Ensuring the Code's alignment with Islamic values and principles.
- Addressing gaps and improving inclusivity, gender mainstreaming, and protection provisions.
- Incorporating best practices from national, regional, and international standards.
Scope of Work
The Junior Non-Key Expert will undertake the following tasks
1. Review of BTA Parliament Bill No. 336 (Proposed Bangsamoro GAD Code)
- Examine the objectives, scope, and content of the proposed GAD Code.
- Evaluate its alignment with Islamic values and principles, while ensuring inclusivity.
- Identify strengths, gaps, and areas for improvement, particularly regarding its practical application and enforceability.
2. Comparative analysis
- Conduct a benchmarking exercise to compare the proposed Bangsamoro GAD Code with: International standards on gender and development (e.g., CEDAW, SDG 5); Relevant national and regional laws in the Philippines and other comparable contexts.
- Highlight best practices and successful models, drawing lessons to inform recommendations for the proposed Code.
3. Development of recommendations
- Provide actionable recommendations to address identified gaps or weaknesses.
- Suggest strategies for strengthening gender mainstreaming, inclusion, and protection provisions.
- Ensure recommendations are both context-sensitive and implementable within the BARMM governance framework.
4. Final Report
- Prepare a comprehensive report detailing findings, recommendations, and suggested amendments to the proposed Bangsamoro GAD Code.
- Present key findings and recommendations to the Office of the Floor Leader, BTA Parliament, ensuring clarity and alignment with the legislative process.
Requirements
General Qualifications and Skills
- Bachelor’s degree in Law, Public Administration, Gender Studies, or a related field. A Master’s degree is an advantage.
- Excellent communication and presentation skills.
- Strong analytical and writing skills, with the ability to produce high-quality reports.
- Fluency in English is required
- Knowledge of Tagalog or a local dialect is an asset
General Professional Experience
- At least 5 years of experience in legislative analysis, gender mainstreaming, or policy development.
- Demonstrated knowledge of Islamic principles and their application in governance.
- Experience in conducting comparative legal or policy analysis is preferred.
Specific professional experience
- Familiarity with the Bangsamoro governance structure, legal frameworks, and cultural context is a strong asset.
- Proficiency in gender analysis and development frameworks.
